Appeal of Tax Refund Collection for Outstanding Offender Supervision Fees
RIGL §42-142-7 allows the Rhode Island Department of Corrections (RIDOC) to collect fees owed from some or all of a tax refund. RIDOC will submit such liability to the Tax Administrator of the State of Rhode Island who will subtract outstanding, unpaid fees from any income tax refund that is due. The request will be submitted to the Tax Administrator until the account is paid in full and/or current, subject to the right to an appeal.
This action can be appealed in writing, but appeals must be received before January 1st.
- If a written appeal is received before January 1st, the RIDOC will not submit the liability while it considers the appeal.
- If a written appeal is not received before January 1st, the RIDOC will submit the liability to the Tax Administrator.
Reasons to Appeal
- You don’t believe you owe fees
- You don’t believe the amount is correct
- You have a financial hardship and are asking for a waiver, postponement or reduction
- You file a joint return with your spouse who owes no money to the RIDOC
How to Appeal
Appeals must be submitted in writing using only one of the following means:
1. Fill out the Probation & Parole or Home Confinement Appeal Form below and email it to the address listed, or
2. Send an email to the Probation & Parole or Home Confinement email address below, or
3. Print the Probation & Parole or Home Confinement Appeal Form, fill it out and mail it to the address listed below.
